Due Process is not meant to cover people INVADING our country. If it did, we could have never been able to win the Spanish American War. Just because invaders aren’t wearing a uniform does not mean that they are friendlies. I argue that they are far from friendly when they abuse our laws and hide from ICE. What he didn't count on was the standing army in each state. The Nat Guard as awesome as they are, are called Oregon (state) National (federal) Guard (Army/Air Force) - they are NOT the militia. What then is the militia? Here is the constitutional understanding of THE MILITIA:
1. An army composed of ordinary citizens rather than professional soldiers.
2. A military force that is not part of a regular army and is subject to call for service in an emergency.
3. The whole body of physically fit civilians eligible by law for military service.
4. In the widest sense, the whole military force of a nation, including both those engaged in military service as a business, and those competent and available for such service; specifically, the body of citizens enrolled for military instruction and discipline, but not subject to be called into actual service except in emergencies. (not the National Guard)
5. Military service; warfare. (In our states - the Nat Guard can be called across the ocean)
6. An army of trained civilians, which may be an official reserve army (again, not the Nat Guard), called upon in time of need, the entire able-bodied population of a state which may also be called upon, "or a private force not under government control."
7. The entire body of physically fit civilians eligible by law for military service. "Congress shall have power to provide for calling forth the militia"
How has the nation and our state responded to this? Well I'd prolly go to jail for even saying it.
